1. Service Description

CreoAds (creoads.ai) is an AI-powered software-as-a-service platform that generates ad creatives for brands. By accessing or using CreoAds, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Acceptable Use

You agree not to:

• Use the service to generate content that is illegal, harmful, deceptive, or infringes on the rights of others.
• Attempt to reverse-engineer, abuse, or overload the platform or its APIs.
• Resell or redistribute the service itself without written permission.
• Use automated scripts or bots to access the service outside of approved integrations.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

3. Credits and Payment

• CreoAds operates on a pay-as-you-go credit system. Credits are purchased in advance and consumed when generating or editing ad creatives.
• Credits are non-refundable once purchased. Unused credits do not expire.
• Pricing is subject to change with reasonable notice. Existing purchased credits will remain valid at their original value.
• Failed generations due to platform errors will be automatically refunded in credits.

4. AI-Generated Content Disclaimer

All ad creatives produced by CreoAds are generated using artificial intelligence. While we strive for high quality, AI-generated outputs may contain inaccuracies, artifacts, or unexpected results. You are responsible for reviewing all generated content before publishing or distributing it. CreoAds does not guarantee the accuracy, suitability, or effectiveness of any generated creative.

5. Intellectual Property

You retain full ownership of the ad creatives generated through your use of CreoAds. By using the service, you grant CreoAds a limited license to process your brand assets (logos, colors, descriptions) solely for the purpose of generating your requested creatives. We do not claim ownership of your input data or generated outputs.

6. No Guarantee on Ad Performance

CreoAds provides tools for generating ad creatives but makes no guarantees regarding the performance, conversion rates, or effectiveness of any generated ads when used in advertising campaigns. Ad performance depends on numerous factors outside our control, including but not limited to targeting settings, ad platform algorithms, market conditions, audience behavior, and campaign budgets. You are solely responsible for testing, measuring, and optimizing your ad campaigns.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to CreoAds. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of planned downtime. AI generation capabilities depend on third-party providers and may be subject to their own availability and rate limits.

8. Account Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the service in a manner that could harm other users or the platform. Upon termination, your access to generated creatives and brand data will be revoked. Any remaining credits on a terminated account are forfeited and non-refundable.

9. Limitation of Liability

CreoAds is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, CreoAds and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service. Our total liability shall not exceed the amount you paid to CreoAds in the twelve months preceding the claim.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these terms or your use of CreoAds shall be subject to the exclusive jurisdiction of the courts located in India.

11. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised terms. We will notify users of material changes via email or in-app notification.
